Open water swimming in the Eastern Cape got a further boost over the weekend with the launch of the inuagral EP open water swimming series which kicked off on Sunday at the pristine canals of Marina Martinique. Consisting of six race days this season, the Series will take place on a monthly basis in the Marina which offers ideal open water swimming conditions.
The Series will consist of a 1km, 3km, 5km and 10km swim and is aimed at attracting social swimmers into the open water environment to boost the provincial age groups teams, in particular the Masters teams.
Michael Marais dominated the events on Sunday morning, winning the 5km and 1km events.
The next event in the Series will be taking place over the weekend 21/22 November with further information available on the website www.ecswim.co.za or from Zports on 041 484 7860.

reader has contacted me about a problem involving her recent internal
disciplinary hearing, at which she was refused union representation.
As a union member, she asked that a union representative accompany her
in order to explain proceedings, since she has only a Grade 8 education
and felt that her reading and social skills were therefore inadequate.
When the employee arrived at the hearing, her employer denied the
request, citing several reasons. She requested a postponement in order
to arrange another representative, but returned again with a union
official.
The employer explained that union officials were not allowed to
represent employees at in-house disciplinary hearings.
The employer referred her to the disciplinary hearing notice, which
stated that she was only entitled to assistance from a representative,
fellow employee or shop steward from her place of work. The
poorly-educated employee had not understood this, nor shown her union
the notice when she approached them for help.
Our reader and her representative walked out of the hearing, which
continued. The outcome resulted in dismissal from her job.
She now feels that she has been " . . . denied my legal right to be
represented by a union official of my choice".
The little information I have implies that the arbitrator in this case
observed that the provisions regarding employee representation at
disciplinary hearings in Schedule 8 of the Code of Good Practice
Dismissal, did not include union officials and legal practitioners. The
reason for this is that internal disciplinary proceedings must be
handled with minimum legal formality.
In a similar case study, a union had no clear right to demand
representation by officials for members at disciplinary hearings unless
this was agreed upon by both parties. In addition, only a recognition
agreement providing specifically for union representation or by someone
not employed by the employer gives an employee the right to this.
The arbitrator noted that the employer's rules regarding representation
at disciplinary hearings were clear and explicit – and that this
information was conveyed adequately to the respondent employee at the
time. He therefore ruled that on the basis of employee representation,
the dismissal was procedurally fair.
I later discovered that our reader's application was viewed as
frivolous and vexatious by her employer – and that she had submitted a
referral to the Commission for Conciliation, Mediation and Arbitration
(CCMA) in the full knowledge that outside representation was not
permitted, and therefore in the full knowledge that she had no case. As
a result, the applicant and the union were ordered to pay the costs of
the CCMA, and the costs incurred by the employer.
From the above it is clear that employers are entitled to have rules
regulating employee representation at disciplinary hearings and that
employees do not have an automatic legal entitlement to be represented
by a person other than an employee of the employer.
Therefore, an employee must submit a proper application to the employer
should he or she seek representation by a person other than an employee
of the employer – and state reasons why a company representative is
deemed unsuitable.
The employer will consider the application, and make a decision. If the
employee does not submit such a request to the employer prior to the
disciplinary hearing, the employee has no right to simply arrive at the
disciplinary hearing accompanied by a representative from outside the
organisation.

Amphitheatre next week on 28 and 29 October. The "Blacks Only" comedy
show will be hosted by acclaimed comedian, David Kau. He will be joined

Impoverished residents who own a property and received land through
South Africa's Land Restitution Programme will now qualify for the
Nelson Mandela Bay Municipality's Assistance to the Poor (ATTP)
Programme.
This is especially important since a clause in the institution's ATTP
Policy clearly states that residents who own more than one property are
not eligible for the free basic services provided with this programme.
As a result, many people, who are in need of the assistance, were
disqualified. The Municipality's Council decided on October 15, that:
"Indigent persons who qualify for the ATTP subsidy and who are the
recipients of land from the Land Reform Process, should be exempted
from clauses 2.1.1, 2.1.2 and 2.1.3 for a period of 10 years from the
date of transfer and thereby receive a subsidy on their service charges
on their land reform property while they remain the owner of such
property; over and above any ATTP subsidy they receive for occupying
any other property.
"If development takes place on the land reform property within the 10
year period, the ATTP subsidy will then only be granted in terms of
clause 2.1.14 (family house) on the second property."
This would mean that disadvantaged beneficiaries of the Fairview,
Colchester and the Salisbury Park Land Restitution claims can still
apply for assistance.
Qualifying Criteria:
- The total household income of applicants, from all sources,
must not
exceed the equivalent of two State welfare pensions, currently
amounting to R2 020,
- The account holder must apply in person and must reside on
the property
in respect of which assistance is sought,
- The applicant must be an account holder and reside on the
property in
respect of which assistance is sought,
- A tenant can apply for the benefits in respect of the
charges he/she
are billed for and the landlord will still be liable for all ownership
related charges such as rates,
- The account of a deceased estate may be subsidized under
the scheme, if
the surviving spouse or dependants of the deceased, who occupy the
property, apply for assistance. All other conditions of the scheme will
still apply, and;
- The following child grants received by a household will be
excluded
from determining household income, provided proof of such grants is
supplied by the applicant: Foster Child Grant, Care Dependency Grant
and Child Support Grant.
The Assistance to the Poor Programme has shown exceptional growth since
its inception on 14 July 1997 that currently 96 817 households receive
free water (8kl), basic sanitation, electricity (75kW) and property
rates subsidy to the tune of R255 million. This figure is expected to
increase to R492 million by 2010/11 and will benefit 124 000
impoverished households.

The
"Independent Minds" Hip Hop Group has been rehearsing Hip Hop with a
score of New Brighton teenagers at the Red
Location Museum for the past few months.
This community recreational activity, initiated by
the "Independent Mind" Hip Hoppers, keeps the youth from Ward 15
busy and away from the streets. Through the messages in their Hip Hop
songs they positively challenge crucial social issues, which are well
received by their peers, as the message comes under the banner of the
youth - and through song and dance.
The Hip Hoppers performance is scheduled to take place at Red
Location Museum outdoor arena on 31 October 2009, between
12:00 and 18:00. Entrance is Free.
Other Hip Hoppers from Nelson Mandela Bay who would like to join in the
rehearsals - on 26 October from 12:30 – 14:00 - for

Visitors to Chez MyPE will know that the Longhair (my wife) and her
partner in crime, the Apprentice Longhair, have made it their life's
mission to sweep up all abandoned animals and re-home them in loving
environments.
A couple of weeks back we found a cute little allsorts wandering around
Ascot Road. She was promptly swept up, cooed and fussed over, fed and
watered and transported back to the carage house of the baronial home
for a sleep over whilst the 'girls' worked on Grumply old me to gain
the male acceptance of ANOTHER animal.
Eventually sanity prevailed, although the Apprentice Longhair is still
a little grouchy, see: Where does all the fur come from?
AND, whilst
you are there please sign the Apprentice Longhair's petition
to get the Jonas Brothers to South Africa.
But back to Amber, as the Longhair writes; "This beautiful girl was
found wondering around Greenacres. Although timid in the beginning she
really warmed up and turned out to be the most gentle and intelligent
young lady.
We guess she was brought into town by the street vendors, on the Cape
Road corner near the new KFC,
and then abandoned, as when we were
taking her to the Animal
Welfare Society (thanks Sharon) she growled at
them.

Very protective after spending just one night with us. So whoever is
fortunate enough to adopt her is guaranteed love, devotion and complete
protection.
I have picked up numerous dogs in the past but she has just got
something about her - it could be her incredible intelligence or her
gentle nature or her sense of humour.
So if you or anyone you know is looking for a companion please give

op haar lewensgehalte. Volgens haar, het sommige keelvol-inwoners al
hul eenhede verkoop.
Die "skuldige" partye skuld glo ook groot bedrae aan agterstallige
heffings.
Sy
sê oor die jare het die verskeie bestuursagente nie die trustees
geadviseer hoe om dié inwoners te hanteer nie en/of die trustees het
nie die reëls geïmplementeer nie.
Verder is dit haar opinie dat
die trustees amper "geheimsinnig" optree en dat geskrewe klagtes aan
die bestuursagent nooit beantwoord of erken word nie.

in Port Elizabeth sê, kragtens artikel 35(1) van die Deeltitelwet Nr 95
van 1986, word deeltitelskemas deur bestuurs- en gedragsreëls beheer en
bestuur.
"Indien die standaard-reëls, of dié wat deur die
ontwikkelaar ingestel is, nie effektief is nie, mag die eienaars die
reëls vervang of uitbrei om by die behoeftes van die betrokke skema te
pas."
Schaëfer sê 'n effektiewe manier om gedragsreëls af te
dwing, is deur die oplegging van waarskuwings en, indien oortreders nie
gehoor gee nie, boetes.
Volgens haar moet bogenoemde deur die
trustees, wie jaarliks deur die eienaars gekies word, hanteer word.
"Dit kan ook aan die bestuursagent gedelegeer word."
Schaëfer
sê hoewel die doel van die gedragsreëls is om die wyse waarop die
inwoners hulself gedra, te reguleer, sal dit slegs effektief wees
indien dit op eienaars en inwoners afgedwing word. "Eienaars en
inwoners moet besef hulle het die mag om hul regte te beskerm en om nie
deur 'n paar inwoners geterroriseer te word nie."
Sy sê dit
vereis egter dat die eienaars en inwoners pro-aktief aan die bestuur
van die skema moet deelneem. "Hulle kan dit doen deur oortredings en
ongewenste gedrag by die trustees of bestuursagent aan te meld."

Properties
PE sê eienaars moet ook die moeite doen om die vergaderings van die
regspersoon by te woon en om die trustees dáár opdrag te gee om
ongewenste situasies aan te spreek.
"Daar is 'n plig op die
trustees om hul funksies (soos beskryf in die Deeltitelwet) behoorlik
uit te voer. Dit sluit in om oortredings en klagtes te ondersoek en aan
te spreek, om stappe te neem om heffings in te vorder, ensovoorts."
Bigara
sê indien die trustees hul take nie uitvoer nie, verbreek hulle die
vertrouensplig wat die wet op hulle plaas en kan hulle, in sekere
omstandighede, persoonlik aanspreeklik gehou word vir skade wat deur
die regspersoon gely word.
"Indien eienaars voel dat die
trustees nie hul verpligtinge uitvoer nie, kan hulle nuwe trustees by
die algemene jaarvergadering kies. Andersins kan hulle stappe, soos
voorgeskryf deur die wet, neem om die trustees af te dank en nuwes te
kies."
Indien die bestuur van die skema deur 'n bestuursagent
hanteer word wat nie hul mandaat doelgerig uitvoer nie, kan hul dienste
beëindig word en 'n nuwe agent aangestel word, aldus Bigara.
"Hoewel
dit verstaanbaar is dat eienaars wie hulself in die leser se posisie
bevind, magteloos voel, is dit noodsaaklik dat hulle hulself bemagtig
deur kennis in te win aangaande hul regte."

Elizabeth, 22nd and 23rd October, 2009. Ian Gray, NSRI Port Elizabeth
station commander said: "At 17h15 (Thursday 22nd October) NSRI Port
Elizabeth's volunteer duty crew were placed on alert by the Transnet
National Ports Authority following a request for urgent medical
assistance from the 225 metre bulk carrier Pioneer Pacific sailing past
the coast of South Africa, en route to Brazil, reporting a 26 year old
Chinese seaman on-board suffering from a suspected fractured ankle and
requiring a medical evacuation from the vessel to hospital.
It is believed that the injury was sustained after steel sheets had
fallen on the sailors ankle.
"At that stage the vessel was 12 hours sailing, at best speed, from the
Port of Port Elizabeth, and the Transnet National Ports Authority
arranged for the Maritime Radio Services to establish a VHF radio
telephone link between the ship and the Metro Ambulance and Rescue
Services duty doctor, dr. Wayne Smith, and medical advice was given by
VHF radio link to the on-board ships medic to assist in stabilising the
patient until the most suitable means of casualty evacuation could be
arranged.
Medical monitoring of the patients progress was continued throughout
the night by dr. Smith, while the ship motored towards Port Elizabeth,
and it was arranged at first light today (23rd October), based on the
deterioratng condition of the patient and on the risk of further
possible irreparable damage to the limb, for a South African Air Force
(SAAF) 15 Squadron, Charlie Flight, BK-117 helicopter, to depart Port
Elizabeth at 11h30, accompanied by 2 Guardmed paramedics and 2 NSRI
rescue swimmers, to fly out to rendezvous with the ship 20 nautical
miles East of Port Elizabeth and casualty evacuate the patient by
helicopter.
On arrival on-scene, in relatively calm sea conditions, the NSRI
rescue
swimmers and a paramedic were winch hoisted onto the ship and treatment
was administered to the patient who was then secured into a specialized
stokes basket stretcher and winch hoisted into the helicopter.
On-board the helicopter, and while en-route to hospital in Port
Elizabeth, the paramedics provided further treatment to the patient who
was transported, aboard the helicopter, in a stable condition to
hospital where he is receiving further treatment."Full Story: |

part of Rocktober 2009, Johannesburg-based band, Zebra and Giraffe is
set to take to the stage at the Boardwalk Amphitheatre on Friday, 30
October 2009.
The unusual band is the brainchild of Greg Carlin and their interesting
taste in style and fashion comes across in their eclectic music which
has elements of Muse, Mutemath and My Chemical Romance.
At the 15th annual SAMA awards, the band won "Best Rock Album" award
for their debut album, "Collected Memories". They also won an award for
the "Best Alternative Music" at the MTV Africa Music Awards (MAMAs) in
Nairobi, Kenya this year.
The album was put together almost entirely by Greg Carlin who put
together all of the tracks himself except for the drums. For live
performances, Carlin puts together a highly talented band of musicians
to perform with him. However, he switches easily between instruments
during live performances and is equally proficient on each one.
Don’t miss out on this unique live performance by Greg Carlin and his
"herd" of muso's.
The show is live at The
Boardwalk Vodacom Amphitheatre on Friday, 30

Zebra and Giraffe is the 12 lettered pseudonym of Johannesburg
musician, Greg Carlin.
Online Magazine, Mahala, wrote
this of Zebra and Giraffe: "When they unveiled an as-yet unnamed new
song, it was vintage Zebra
& Giraffe, starting quiet and getting suddenly, expansively
loud. That song seems to draw a line around the pattern that has pushed
this band to this point: intensely layered, wavering guitar effects,
swirling keyboard areas which steady and soar, spiking synth lines
which burst from nowhere to nowhere, and a signature vocal attention to
the intricate spaces between howling and brooding. In turn, Carlin can
croon and cry, Alan Shenton's guitar can be both prosy and overwrought,
Darren Leader's drums can tick and tremble and terrorise; together,
they dance through the set-list with an ease and enthusiasm that even
made a Chris Isaak cover sound cool."

On Saturday 24 October MyPE selected a 'basket of goods' and went off
on a comparison shopping spree at the following stores; Pick 'n Pay
William Moffet, Newton Park Superspar, Checkers
Greenacres, Woolworths Greenacres and Shoprite
Greenacres.
The rationale behind this comparison shop was to select a basket of
'essential' goods used by a family of four with one dog and one cat and
do a comparison of what said basket of goods would cost this nuclear
family for the week.
Please bear in mind that we have tried to reflect the goods and prices
in an as real world as possible manner - if this comparison shop has
taught us one thing it is that our perceptions of the different stores
heavily influence our shopping patterns and store loyalty.
The findings were quite

A comparison table such as the above is pretty meaningless without some
form of comment about each store:
Newton Park Superspar
- Pro's: Clean Trolleys and Store, Easy Layout, Quickest
Shop, helpful staff.
- Con's: The Apprentice Longhair added a Jonas
Brothers magazine (Don't forget to sign her Jonas Brothers Petition) to the
trolley. At the checkout the cashier had to manually ring the price up
which he did as R17.99 which was incorrect and should have been R17.95.
It was pointed out and he said that the rounding would take care of it
- WRONG, especially when you pay by credit card. So, Mr Cashier, as
promised you get a BAD mention on MyPE - it is the TINY little things
that count my son.
Pick 'n Pay
William Moffet
- Pro's: Huge Range, Pro-active Fish shop staff
- Con's: Dirty Trolleys. Staff unhelpful - example: Question;
"Do You work in this aisle?". Answer; "No", and he just walked away.
The correct answer should have been; "No, but I will try and assist
you."
Checkers
Greenacres
- Pro's: Second Quickest Shop, second easiest layout.
- Con's: Aisles way to narrow, the marketing of their wine
shop does not match with the selection, not one smiling staff member.
Shoprite
Greenacres
- Pro's: Widest Aisles
- Con's: Struggled to find the cheese, dirtiest shop, I was
shocked that the chicken seemed to be the most expensive but the
quickest mover.
Woolworths Greenacres
- Pro's: That upmarket feeling, attractive packaging
- Con's: Customers ("Mam, the next time you attempt to mow me
down with your trolley I will deflate your trolley wheels!"), What is
it with the black shelves and packing cases? (My Mom always taught me
that black hides germs). I saw one shopper abandon his cart as he
couldn't find a specific item, nor a staff member to help.
If time is money in your life then the two stores to patronise are
Newton Park Superspar or Checkers Greenacres - my journeys around both
were very quick.
What puzzles me about store layouts is the oftentimes strange way in
which different products are placed and how that, in product areas
where people are apt to 'browse', the aisles are woefully
inadequate in size. I for one will rather abandon my shop than take
something which I do not want.
If there is one thing that I have become 'blind' to is the 'walk of
death' as you push your trolley closer to checkout. Every single damn
shop has an array of small sweet items placed just within reach of the
glazed doughnut monsters who beg and plead with their parents to buy
them these sugary treats. Of course you also get the scheming little
monsters who idly toss these items into the family trolley when Mom and
Dad are not looking. Not cool shop owners, not cool.
One other thing that irritates the hell out of me is when
products and prices are 'hidden away' below knee height. Maybe one day,
layout planners will utilise the space below knee height for storage of
GENUINE Bulk Buy offers of the products that are directly above and
more visible. Wouldn't it be great to have a push button to
summon a staff member to retrieve your bulk buy items of choice?
Many years ago I did some work at a large privately owned supermarket
in Veeplaas. Now, this owner had his sales pitch waxed. Whenever a
Mother and her child/ren entered the store he had a runner fetch a
trolley and push it around the store for the shopper, giving advice and
doing a subtle sales pitch whilst making the shopper's life a lot
easier.

to current gale force winds being experienced stretching from Cape
Town up the East Coast which peaked during the night at
130km/hour and remain gusting in excess of 100 km/hour the NSRI
are urging boaters not to launch to go to sea unless it is absolutely
necessary.
Anyone at sea on any kind of vessel should wear their life-jackets at
all times while at sea.
Anglers fishing along the shores should excercise extreme caution.
Strong winds are expected to continue into Tuesday and reach up the
